OVERVIEW

Welcome to Melori. The terms “we”, “us” and “our” refer to Melori, a brand operated by FLEXİSB DİJİTAL TASARIM VE YAZILIM HİZMETLERİ SANAYİ TİCARET LİMİTED ŞİRKETİ (“FLEXISB”, Türkiye), which operates this website and store (the “Services”).

For eligible transactions, payments may be processed via Shopify Payments on behalf of COSMO TRADE LLC (USA) as the Merchant of Record. Your card or bank statement may display COSMO TRADE LLC and/or MELORI. The merchant responsible for your specific transaction is the entity identified at checkout and in your order confirmation.

These Terms of Service (the “Terms”), together with policies referenced here (including our Privacy Policy, Shipping Policy, and Return & Refund Policy), describe your rights and responsibilities when you use the Services. Nothing in these Terms limits any non-waivable consumer rights under applicable law.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.


1) Access and account

You must be at least the age of majority in your jurisdiction to use the Services, or use them with appropriate parental/guardian supervision where permitted.

You agree to provide accurate, current, and complete information at checkout or when creating an account and to update it as needed.

You are responsible for safeguarding your account credentials and all activity under your account. You may not sell, transfer, assign, or license your account.

2) Products and content

We aim to present products accurately. Colors and appearance may vary by device and settings. Product descriptions and availability may change, and items may be discontinued or quantity-limited.

We are an independent retailer (not a manufacturer). Product information on the Services is for general informational purposes and is not medical advice. Always follow the manufacturer’s directions and consider a patch test where appropriate.

3) Orders

Placing an order is an offer to purchase. We may accept or decline orders for legitimate reasons (e.g., stock limitations, fraud/risk screening, verification issues). If we cancel, we will notify you using the contact details provided at checkout and, where applicable, issue a refund.

Returns and refunds are handled under our Return & Refund Policy. We do not offer direct exchanges.

You represent your purchases are for personal or household use and not for commercial resale where prohibited by law.

4) Prices and billing

Prices and promotions may change. The price charged is the price shown at checkout at the time you place your order. Taxes, duties, and shipping fees (if any) are shown at checkout before you pay.

You represent you are authorized to use the payment method provided and that the payment details are accurate.

5) Shipping and delivery

Shipping scope, carriers, handling time, and delivery estimates are described in our Shipping Policy.

Delivery timeframes are estimates and not guarantees; delays may occur due to factors outside our control (e.g., carrier delays, weather, high-volume periods).

If tracking indicates “delivered” but you did not receive the package, we will follow the investigation process described in our Shipping/Return & Refund Policies. Where the carrier cannot substantiate delivery to your address, we will refund or reship in line with those policies.

6) Intellectual property

The Services and content are owned by Melori, its affiliates, or licensors and protected by law. You may use the Services for personal, non-commercial purposes only. You may not reproduce or exploit content without prior written permission, except as allowed by law.

Trademarks and logos belong to their respective owners. Shopify is a trademark of Shopify.

7) Third-party tools and links

We may provide access to third-party tools or links “as is”. Your use is subject to the third party’s terms and policies. We are not responsible for third-party services.

8) Relationship with Shopify

Our store is hosted on Shopify. Shopify provides the platform, but Shopify is not a party to your purchase and is not responsible for our products, pricing, shipping, returns, refunds, or customer support.

9) Feedback and reviews

If you submit reviews or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use it to operate and promote the Services, subject to applicable law. You are responsible for the content you submit and must not post unlawful, misleading, or infringing content.

10) Prohibited uses

You agree not to misuse the Services, including by violating laws, infringing intellectual property, transmitting malware/spam, scraping without permission, impersonation, or attempting to bypass security. We may suspend or terminate access for violations.

11) Disclaimer of warranties

The Services and products are provided “as is” and “as available” to the fullest extent permitted by law, without warranties of any kind. Some jurisdictions do not allow certain disclaimers; in that case, those disclaimers do not apply to you to the extent prohibited.

12) Limitation of liability

To the fullest extent permitted by law, Melori and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for claims relating to a product will not exceed the amount you paid for that product, except where such limitation is prohibited by applicable law.

13) Termination

We may suspend or terminate access to the Services for violations of these Terms or where necessary to protect the Services, users, or comply with law.

14) Governing law and dispute resolution

Consumer rights: These Terms do not limit mandatory consumer rights in your country of residence.

United States (where permitted): If you are a consumer residing in the United States, and to the extent permitted by law, Kansas law may govern these Terms (excluding conflict-of-law rules).

Arbitration (US consumers; where permitted): To the extent permitted by applicable law, disputes between you and us may be resolved by binding individual arbitration, except that either party may: (i) bring an individual action in small claims court, and/or (ii) seek temporary or preliminary injunctive relief to protect intellectual property or prevent unauthorized access or abuse. You may opt out of arbitration within 30 days of your first purchase by emailing support@melori.com with subject “Arbitration Opt-Out” and including your name and order number.

UK/EEA and other regions: If you reside in the United Kingdom, European Economic Area, or another jurisdiction that restricts arbitration clauses for consumers, disputes will be handled under the mandatory consumer protection rules applicable to you, and you may bring claims in the competent courts of your country of residence where permitted by law.

15) Changes to these Terms

We may update these Terms from time to time. The most current version will be posted on this page with a revised “Last updated” date. Where required by law, we will provide additional notice of material changes.

17) Store Credit / Rewards Program (Melori Wallet)

We operate a voluntary store credit rewards program. The following terms apply:

  • There are no conditions to earn store credit. Store credit equal to 10% of the amount you pay for products — excluding shipping fees and taxes — is credited to your account.
  • Store credit is added to your account approximately 14 days after your order date.
  • Store credit is held and redeemable in the currency associated with your market at the time it is earned, and can be applied at checkout when you are signed in to your Melori account.
  • Store credit expires at the end of the calendar year in which it was earned. Any unused balance is removed after December 31.
  • If an order is cancelled or fully returned, the related store credit is removed from your account. For partial returns, store credit equal to 10% of the returned product amount is removed.
  • Store credit can only be used on melori.com. It is not redeemable for cash and cannot be withdrawn or transferred.
  • We may modify or discontinue the program at any time; changes will be posted on this page and on our store credit information page.
